Notice regarding the contract terminated

Contract No. MBHPD/337011084/079/80-02 "Upgrading Improvement of Sandhikharka-Bhandar-Ratanmare-Gokhunga Road section (27.26 km) of Ridi-Balkot-Hansapur, Pyuthan-Surkhet Highway(NH-19) to Blacktopped Standard" between this project office and Shree Shrestha Construction Company (Hetauda) Pvt. Ltd., Samakhushi, Kathmandu. Since the work has not progressed as per the agreement and has not shown any interest in completing the work, despite verbal and written requests from the office on various dates, the construction work has been stalled for a long time and no interest has been shown in completing the construction work. Therefore, why not terminate the contract agreement as provided in Section 59 of the Public Procurement Act 2063 and Sub-rule 2 of Rule 128 of the Public Procurement Regulations 2064 and GCC Clause 72.1 (b), (c) of the purchase agreement? If there is any reasonable reason not to terminate the contract, the authorized representative is advised to appear in person at this office within 15 days from the date of publication of the notice with a credible explanation. Otherwise, in accordance with the terms of the contract agreement mentioned above and the prevailing laws, rules and regulations, action will be taken to terminate the contract and blacklist it, forfeit the performance security, advance payment security, deposit amount, and recover the remaining expenses incurred for the work as government dues.
