15-day notice regarding termination

Pushpalal (Mid Hill) Highway Planning Office, Palungtar, Gorkha, under Contract No. MIDHLPD/337011144/077/78-305, Construction of Likhu Khola Bridge along Pati Bhanjyang Chahhare Road Section of Mid Hill Highway, Nuwakot (RCC 1*25m), an agreement was signed on 29/10/2077 between Pushpalal (Mid Hill) Highway Planning Directorate, Kathmandu and construction contractor Shree Ganapati Group of Construction Pvt. Ltd. Kathmandu. It seems that no resources (manpower, construction materials, tools/equipment etc.) have been mobilized at the construction site for a long time. Since the construction work has not been completed with sincerity despite verbal and written requests/inquiries from this planning office on various dates, this notice has been issued to the authorized person to appear in this office with the reason why the work could not be completed within 15 days from the date of publication of this notice and the updated revised works schedule that can complete the work, a reliable plan for resource mobilization and a commitment to complete the work. If the readiness to start the work is not shown within the above period, it is also informed that the contract agreement will be terminated and further action will be taken as per the provisions of Sub-section 7 of Section 59 of the Public Procurement Act 2063 and Rule 128 of the Public Procurement Regulations 2064 and GCC Clause 72.1 of the Contract Agreement. This notice has been published to submit within 15 days if there is any reason not to terminate the contract.
