As per Section 62 of Chapter 9 of the Local Government Operation Act, 2074 BS, under the Financial Jurisdiction of Rural Municipality and Municipality, a contract has to be made for the collection of fees from the concerned service provider at the rate prescribed by the Financial Act of Bhimphedi Rural Municipality, 2082 BS for the rental of the commercial shutter building constructed, operated and managed by this Bhimphedi Rural Municipality. Conditions:-

1. The term of the said contract shall be from the date of agreement to the end of Ashadha of the financial year 2083/84.

2. The bid form for the aforementioned income contract can be purchased from the office by paying the prescribed fee within the date mentioned in the notice above.

3. The bidder must clearly state the name of the bidder, contract name, contract number, and the name of the submitting office on the outside of the envelope.

4. If the bid for the above work is to be purchased in the name of the firm, copies of the renewal certificate of the firm license, permanent account and VAT registration certificate, and income tax payment certificate must be attached, notarized.

5. The sealed bids can be registered up to 12:00 PM on the day following the last date of purchase of bids. The sealed bids duly registered will be opened at 1:00 PM on the last day of registration in the presence of the representative of the office and the bidder or his representative. However, even if the bidder or his representative is not present, there will be no obstacle to opening the sealed bids of the aforementioned income contract. While submitting the sealed bids, a deposit of 5 percent of the contract amount (10 percent of the amount in the case of non-Nepali citizens) should be deposited in the name of the office of the Village Executive of Bhimphedi Rural Municipality, N.I.C. Asia Bank Ltd. Bhimphedi Branch, Deposit Account No. The original voucher deposited in G& CA503072524001 or a bid bond issued in the name of this office by a commercial bank recognized by Nepal Rastra Bank with a validity of at least 120 days must be submitted.

6. The bid amount must be clearly written in figures and words. If there is a difference between figures and words, the one written in words will be accepted. If the figures and words need to be rewritten, the signature of the bidder must be mandatory in the place where the cut-off is made. If it is a firm or company, it must also have a seal. 7. If the last day of purchase or submission of bids falls on a public holiday, the day after that day will be considered the last day of purchase or submission.

8. If the contractor pays the contract amount in lump sum or in installments, it will have to be paid in 6 installments. At the time of signing the first installment agreement, 25 percent of the total contract amount, 30 percent of the second installment, 15 percent of the third installment and the remaining 3 installments of 10 percent each must be paid within the period mentioned in the agreement. If an agreement is made to pay the amount in installments, the original voucher deposited in the Internal Revenue Account No. 167CA57503077001 in the name of the Bhimphedi Rural Municipality, Village Executive Office, and in the case of the remaining installment, a Performance Bond of a commercial bank recognized by Nepal Rastra Bank with a validity period of 2084 Bhadra mid-late 2084 has to be submitted.

9. The sealed bid should be submitted/registered only in the name of the person/firm in whose name the sealed bid was purchased. A sealed bid purchased in the name of one firm cannot be registered in the name of another firm. If this is found, it will be automatically cancelled.

10. While operating a business in a commercial shutter, it is not permitted to operate/conduct any business prohibited by prevailing laws.

11. Any fees, taxes, charges, etc., including electricity, water, and waste management fees, as per prevailing laws, shall be borne by the person, firm, or company accepting the payment.

12. The Contractor shall be responsible for the cleanliness and general maintenance of the Contract Operation Site throughout the Contract Period. If any loss/damage occurs at the Contract Operation Site during the Contract Period, the Contractor shall repair it himself.

13. After the expiry of the contract period, the contract period may be extended by mutual agreement for a maximum of 1 month, subject to payment of fees/charges at the same rate as before, until the next contract is arranged. In such an extension, the amount due to the rural municipality must be paid in advance.

14. No action will be taken against any bid received after the deadline, not in proper form, submitted with any conditions, or against the terms of the notice.

15. This office reserves the right to accept, reject, partially accept or reject the registered sealed bids.

16. In the case of the points mentioned in this notice, it will be as per this and in the case of the unspecified, it will be as per the Local Government Operation Act, 2074, the Internal Revenue Collection (Contract Arrangement) Procedure of Bhimphedi Rural Municipality, 2075, the decision of the office, agreement and prevailing laws.
