Conditions:

1. The contract period will be 5 (five) years from the date of signing the agreement.

2. The bidder must clearly state the amount he has agreed to pay in figures and words. In case of any discrepancy between figures and words, the words will be considered valid.

3. Apart from the value added tax levied on the contract as per the rules, the contractor will have to bear the advance income tax or other taxes levied as per the prevailing law.

4. A deposit of 5 (five) percent of the total annual amount of the 5 years of the agreed annual amount shall be deposited in cash in the deposit account 22801017500016 of Chandranagar Rural Municipality, Nabil Bank Ltd., Chandranagar and a half-cut of the same shall be submitted along with the sealed bid.

5. Bids can be registered only in the name of the person or firm in whose name the purchase was made. Bids registered in the name of any other firm will not be accepted. Also, bids sent through postal services, couriers, etc. will not be accepted.

6. The sealed envelope must clearly state for which work the bid is being submitted. Also, the name and address of the bidder must be clearly mentioned on the outside of the envelope.

The non-refundable amount of Rs. 1000.- (one thousand) or Rs. 3000.- (three thousand) as specified shall be deposited in the Internal Revenue Account No. 22801017500031 of this Rural Municipality at Nabil Bank Ltd. Chandranagar Branch and the original voucher thereof shall be submitted and purchased from the office of the Chandranagar Village Executive, Chandranagar, Sarlahi and registered at the office of the Village Executive, Chandranagar, Sarlahi by 12 noon on the 31st day. The bid opening will be held on the same day from 2:00 pm. If the last day for purchasing the bid form or the opening day falls on a public holiday, the next day on which the office opens will be considered the last day.

Firm renewal certificate, permanent account number or value added tax registration certificate, tax payment certificate for the fiscal year 2081/082, and certified documents of citizenship certificate must be submitted along with the bid. In the case of an individual, a certified copy of his Nepali citizenship can be submitted along with the bid.

9. In all types of contracts, if any other decision is made by the Government of Nepal under the current legal system, it will be as per that. 10. If there is any outstanding amount due to this rural municipality and any outstanding arrears for goods and services, the contract in the name of such persons will not be approved.

11. This office reserves the right to accept or reject any bid received.

13. Fishing shall not be carried out by any method prohibited by the Act or Law. When catching fish, a fishing rod or net shall be used. And priority shall be given to local fishermen when fishing. When catching fish, poison, current or any other method that adversely affects the environment shall not be used. If pesticides are used forcibly, the contractor shall be liable for the loss of property and life caused by this.

14. If the bidder fails to sign the contract or fails to deposit the required amount within 15 (fifteen) days of receipt of the bid acceptance letter (excluding travel time), the amount deposited by him/her as per the rules will be forfeited.

The lump sum amount of the annual contract amount that you have agreed to must be deposited in the internal revenue account of this office and in the case of the remaining installment, a bank guarantee or cash deposit must be submitted. In the case of cash deposit, the agreement will be granted only on the basis of the evaluation done by the rural municipality or the evaluation submitted by a consultancy recognized by the Government of Nepal and the lump sum amount of the annual contract amount of each upcoming fiscal year must be deposited in cash by the middle of Ashar of each current fiscal year.

16. If the installment amount is not paid within the stipulated time, the rural municipality may issue a demand letter within 15 days, 7 days, 3 days and 24 hours.

17. It will be the duty of the concerned contractor to follow the policies and instructions issued by the rural municipality from time to time.

18. If any dispute arises between the contract office and the contractor, the decision of the rural municipality will be final.

19. In cases where it is mentioned in the notice, it shall be in accordance with this notice and in cases where it is not mentioned, it shall be in accordance with the Public Procurement Act, 2063, the Local Government Operation Act, 2074, and the rules and regulations or procedures approved by the Chandranagar Village Executive.

It will be in accordance with the prevailing law. 20. In case of any kind of damage to the contractor during the contract period, the village municipality will not provide any kind of compensation.

21. The contractor shall not be permitted to damage or destroy the physical structure of the pond or to drain or drain excessive water during fishing.

22. In the current condition in which the pond contract is given, after the contract ends, the contractor will have to clean the pond of any weeds and other types of weeds and hand it over to the rural municipality.

23. The contractor or any other person shall not use or sell the water of the concerned pond for any kind of irrigation or other purpose without the prior approval of the rural municipality.
