As per the provisions of Section 62 (a) of the Local Government Operation Act, 2074 BS and Section 8 of the Finance Act of this Gajuri Rural Municipality, 2081 BS, the riverine products extracted from the approved ghats of Malekhu, Belkhu, Trishuli and Dariyal rivers in the Gajuri Rural Municipality area as per the prescribed standards have to be sold at the rate prescribed by the Gajuri Rural Municipality. Therefore, this notice has been published for the information of all concerned to participate in the bidding process subject to the conditions as specified.

Conditions:

1. The bidders who wish to submit their bids may download and upload the bid documents electronically from the website of the Public Procurement Monitoring Office www.bolpatra.gov.np by 1:00 PM on the 17th day (2082/03/22) from the date of first publication of this notice along with the firm's renewed registration certificate, Value Added Tax Registration Certificate, certified copy of the tax payment certificate for the fiscal year 2080/081 and the receipt of cash payment for the bid form fee to this office or the cash voucher deposited in the Internal Revenue Account of this office at the Rastriya Banijya Bank Branch Office, Gajuri, Bank Account No. 10501003010002 or the voucher deposited in the revenue title 14529 on the local level revenue portal. If the last day for submission of bids falls on a public holiday, the work will be done on the next office opening day. While filling the bid form, the bid amount should be clearly mentioned in figures and words. In case of difference in figures and words, the words will be accepted.

2. The deposit amount to be paid at the rate of at least 5 percent of the number of bids should be deposited in the deposit account No. 10501003000002 (for deposit) of this office, Rastriya Banijya Bank Branch Office, Gajuri, and the original bank voucher or a bid bond issued in the name of this office from a “A” class bank licensed by Nepal Rastra Bank with a validity of 150 days, mentioning the bid number and name, must be submitted electronically.

3. Bids purchased in the name of one firm or organization cannot be submitted in the name of another firm or organization. Bid documents received in due course will be opened at this office from 1:15 PM on the last day for submission of bid documents in the presence of representatives of various offices, construction entrepreneurs or their representatives. Also, if the bidder or his representative is not present at the time of bid opening, there will be no obstacle to bid opening. If the day falls on a public holiday, the work will be done on the next day after the holiday when the office is open.

5. If the bid is accepted, the first installment of 40 percent of the bid amount must be paid within 15 days from the date of receipt of the notice along with the VAT registration certificate. The second and third installments of 60 percent must be paid by submitting a bank guarantee (performance bond) issued by a "A" class bank licensed by Nepal Rastra Bank in the name of this office with a validity period of up to mid-Ashar 2083 BS. In addition, the person or firm bidding for the bid must pay an additional 13 percent VAT amount to this office as per the rules of the total amount to be paid for the bid amount and service fee. As per the rules, the bidder must pay income tax and other taxes separately to the Government of Nepal.

6. If the lease is not collected within the specified time, the deposit amount will be confiscated and the bid will be settled as per the rules. The rivers and streams of this rural municipality

7. The duration of this contract for internal revenue settlement will be from the date of signing the contract agreement with this office for the financial year 2082/083 until the end of Ashadh 2083.

8. No compensation will be claimed in case the work is not resumed for a few days due to strike etc. For this purpose, the extraction of materials from the river area will be allowed only within the scope of the approved Initial Environmental Assessment (IEE) report and within the specified time period.

9. This office reserves the right to accept or reject the bids without assigning any reason in the interest of the rural municipality. The prescribed installment amount must be paid within the stipulated time. No demand for discounting the contract amount due to any circumstances will be accepted by the office.

10. Of the remaining two installments of the contract, the second installment (an amount equal to 30 percent of the contract amount) must be paid by mid-2082 Paush and the third and final installment (an amount equal to 30 percent of the contract amount) must be paid by mid-2083 Baisakh.

11. Bids that do not meet the above conditions will not be included in the evaluation. In the case of matters not mentioned in these conditions, the agreement to be made after the contract acceptance will be in accordance with the prevailing laws and regulations.
