Notice regarding invitation of sealed bids for extraction of riverine products and collection of sales tax

As per the provisions of Section 62 (a) of the Local Government Operation Act, 2074 and Section 9 of the Bagmati Province Economic Act, 2081, the contract has to be arranged to excavate riverine products from the approved ghats of the rivers mentioned in the schedule as per the prescribed standards and sell them at the prescribed rate, interested firms or companies are requested to participate in the bidding process by attaching the renewal certificate of the firm, Value Added Tax Registration Certificate, Tax Payment Certificate of FY 080/81 or certificate of extension of time and certified copies of Nepali Citizenship Certificate along with other necessary documents, subject to the conditions as per the schedule. This notice has been published for the information of all concerned.

Contract Terms and Conditions:

1. The firm or company shall purchase the bidding documents through the e-bid portal of the Public Procurement Monitoring Office within the 30th day from the date of first publication of this notice by submitting an application along with the renewed registration certificate, value added tax registration certificate, certified copy of the tax payment certificate of the fiscal year 2080/81 or the certificate of extension of the deadline, cash voucher deposited in cash in the Inland Revenue Account No. 066010040000013 of this office at Sanima Bank, Branch Office, Bhardeu. The bidder shall have to purchase the bidding documents through the e-bid portal of the Public Procurement Monitoring Office within the office hours. The prescribed bidding fee shall be deposited in the bank account of this office in the above-mentioned account No. The voucher deposited in the above-mentioned account number shall be attached along with the bidding documents. If the last day for submission of bids falls on a public holiday, the said work shall be done on the next office opening day immediately after that.

2. While filling the bid form, the bid amount should be clearly mentioned in words and figures. In case of any difference in figures and letters, the letters will be accepted. In case of the above mentioned security deposit amount, it should be deposited in the security deposit account No. 06601002000003 of this office at Sanima Bank, Branch Office, Bhardeu and its original bank voucher or a bid bond issued in the name of this office from a commercial bank or financial institution licensed by Nepal Rastra Bank, mentioning the bid number and name and having a validity period of at least 120 days, should be submitted.

3. The bidder must fill in all the details mentioned in the purchased bid forms, sign each page and register it through the e-bid of the Public Procurement Monitoring Office by 12:00 PM on the 31st day from the date of first publication of the notice.

4. Bids purchased in the name of one firm or company cannot be submitted in the name of another firm or organization. Bid documents duly received will be opened at this office from 13:00 on the last day for submission of bid documents in the presence of representatives of various offices, construction entrepreneurs or their representatives. Also, if the bidder or his representatives are not present on time, there will be no obstacle to opening the bids. If the said day falls on a holiday, the work will be done on the next day when the office is open.

5. Detailed information regarding the bid is mentioned in the bid form and can be obtained from the same booklet or by contacting this office. This office will not be bound to accept bids submitted after the deadline, without the required formalities or with conditions. This office reserves all rights to accept or reject bids.

6. If the bid is accepted, an agreement will be made with the accepted bidder only after the first installment of 20 percent of the bid amount is compulsorily paid within 15 days from the date of receipt of the notice along with the VAT registration certificate and the voucher is submitted. The second installment of 80 percent will have to be paid by submitting a bank guarantee (performance bond) issued by a commercial bank licensed by Nepal Rastra Bank in the name of this office with a term of up to mid-Ashar 2083 BS. The second installment of 40 percent of the bid amount must be paid by mid-Phalgun 2082 BS and the final installment of 40 percent of the bid amount must be paid by mid-Jestha 2083 BS. If the bid amount is paid in lump sum to the rural municipality, a discount of up to 10 percent will be given and the firm bidding the bid will have to pay an additional 135 VAT amount to this office as per the rules of the total amount to be paid for the bid amount and service fee. As per the rules, the bidder will have to pay income tax and other taxes separately to the Government of Nepal.

7. If the lease is not collected within the specified time, the deposit amount will be confiscated and the bid will be settled as per the rules. The area and quantity of riverine material extraction in the rivers of this rural municipality will be in accordance with the Local Government Operation Act, 2074, laws issued by the concerned local level, provincial laws and prevailing laws or standards. In addition, the environmental study report prepared by this office will be considered an integral part of this bid.
