Notice inviting bids for collection and collection of sales fees

As per Sub-section 2 (d) 1 and (d) 6 of Section 11 of the Local Government Operation Act, 2074, the following internal revenue related contracts have to be arranged for the financial year 2082/83 of Mandandeupur Municipality, this notice has been published to invite interested individuals, firms or companies to submit bids within the following subject areas, not less than the minimum number specified in the details, from the areas mentioned in the approved Environmental Impact Assessment (EIA) Area Determination Report/IEE Report and the Preliminary Environmental Examination Report (IEE) for Chakhola/Aanshikhola and Dhandkhola/Tharkhola rivers, in accordance with the rates passed by the Provincial Economic Act and the approved Environmental Impact Assessment (EIA) for the Indravati River. Contract terms and conditions:
1. While purchasing the bid form, the bid form can be purchased within the office hours of 2082/05/23 by attaching a copy of the Nepali citizenship certificate, personal PAN registration certificate in the case of an individual and a copy of the updated firm renewal certificate in the case of a firm, a copy of the tax payment certificate for the fiscal year 2080/081, as well as a written application, self-declaration letter and a copy of the C.A. Tax registration certificate.
2. While purchasing the bid form for E-Bidding, a copy of the Nepali citizenship certificate, personal PAN registration certificate in the case of an individual and a copy of the updated firm renewal certificate in the case of a firm, FY 2080/081.
Bid documents can be downloaded from www.bolpatra.gov.np through E-bidding by 12 noon on 2082/05/24 along with a copy of the tax payment certificate along with a written application, self-declaration letter and a copy of the M.A. Tax Registration Certificate.
Bid forms can be purchased by depositing the bid fee in Account C.1.1 Internal Revenue Account Mandandepur Account No. 22004010000010, Revenue Heading No. 14229 at Global IME Bank Kuntavesi Branch.
3. The bid forms purchased as per points no. 1 and 2 shall be duly filled in and submitted to the office and E-submission respectively by 12:00 PM on 2082/05/24. The submitted bids shall be opened at 2:00 PM on the same day in the presence of the bidders or their authorized representatives and office representatives present at the office. There shall be no impediment to opening the bids even if the bidder or his representative is not present. While submitting the bid through E-submission, the documents mentioned in point no. 2, bank guarantee, bid fee, Bid Response document in PDF Format shall be submitted.
4. The bid validity period will be at least 90 days.
5. Deposit Amount: Although 5% of the minimum score for the financial year 2082/083 has been specified on www.bolpatra.gov.np, a deposit amount of 5% of the amount including VAT agreed upon by the bidder at the time of submission of the bid shall be deposited in the account C. 3 Mandandepur Deposit Account No. 22004010000008 of this office at Global IME Bank, Kuntavesi Branch, in the form of an original bank voucher or an original bank guarantee letter (Bid security) issued in favor of this office from a commercial bank recognized by the Government of Nepal with a validity of at least 120 (one hundred and twenty) days from the last date of bid registration.
6. While filling the bid, the amount of money offered must be clearly written in figures and words. If the amount written in figures and words is different, the amount written in words will be accepted. 7. Within 7 (seven) days from the date of receipt of information regarding the acceptance of the bid, 30 (thirty) percent of the bid amount (including VAT) must be paid in cash and the remaining amount must be paid in cash to this office through a commercial bank recognized by the Government of Nepal.
Each installment amount (including the amount for M.A. tax) issued by the bank will have to be accompanied by a separate performance bond.
8. The contractor shall be entitled to collect fees only at the rates specified in the subject area specified in the contract. The rates of collection and sales fees shall be provided along with the bid form.
9. In addition to the rivers/streams mentioned in this notice, new areas (rivers/streams) have been identified and are being used for development projects to be implemented by the Government of Nepal/donor agencies as per the decision of the Government of Nepal, Council of Ministers dated 2072/10/20.
In the case of the sale of construction materials used, the municipality will recover the sales price from the relevant project based on the quantity used by the relevant project (within the scope of the approved IEE).
10. No person/firm/company/organization other than the contractor approved by this municipality to excavate and sell and distribute riverine materials other than in the quantities and at the time specified in the EIA/IEE shall excavate and collect riverine materials.
No. If unauthorized excavation and collection is found, action will be taken in accordance with the prevailing law.
11. If any dispute arises between the contractor and the office regarding the contract, the Mandandepur Municipal Executive will decide to resolve it.
12. The contractor shall be solely responsible for collecting and collecting sales fees. In addition, the contractor shall be responsible for paying all other taxes payable under the prevailing laws, except for the VAT on the contract amount.
13. Gravel, stone, sand, gravel shall not be extracted in a manner that damages private land while extracting gravel, stone, sand, gravel in the sale contract. In addition, gravel, stone, sand, gravel shall be extracted only from the locations specified in the report, leaving 1000 meters below the bridge on the river and at least 500 meters above the bridge.
14. Since the contract is based on annual quantities, no compensation will be provided in case the work is not completed for a few days due to a strike, etc.
15. If the law and standards are not met during district monitoring and monitoring by municipalities and related government agencies, action will be taken in accordance with the prevailing law.
16. The contractor must remove the excavated stone, gravel, sand, and gravel from the area within the fiscal year for which the contract agreement was signed.
17. No stone, gravel, sand, or gravel may be excavated in a manner that changes the direction of river flow.
18. Riverine materials shall be excavated only from the locations mentioned in the report. Also, if approved in the report, there will be no obstacle to excavating riverine materials using machines for the approved period.
19. Cold sand washed with water shall not be transported on blacktop roads with water leaking out. Also, when transporting stones, gravel, sand, and gravel, they shall be transported only by covering them. Also, the water released during the washing of sand shall not be allowed to enter the road.
Dirty water cannot be directly mixed into the river. 20. No demand for discount/waivers of contract amount will be accepted by the office under any circumstances. However, if the annual contract amount quoted is paid in full at the time of signing the contract, the prevailing laws and regulations will apply.
Exemptions will be granted within the perimeter as per the decision of the municipal executive.
21. The office reserves the right to accept or reject any bid received.
22. Other matters not mentioned herein shall be as per the Riverine Materials (Extraction and Utilization) Procedure, 2075 BS and the Standards for Stone, Ballast, Sand Excavation, Sale and Management, 2077 BS, the Standards for Stone, Ballast, Sand Excavation, Sale and Management (First Amendment) Procedure, 2079 BS, the Riverine Materials Utilization and Management Procedure within Mandandepur Municipality, 2075 BS and other prevailing laws issued by the Bagmati Province Government. In addition, the environmental study report prepared by this office at the time of signing the agreement shall be considered an integral part of this bid.
23. Receipts remaining to be certified and issued by the municipality office must be returned to the municipality. Also, records must be certified and maintained as per Schedule-4 (a) of the Standards for Excavation, Sale and Management of Stone, Gravel, and Sand (2079 with Amendments).
24. The contract period will be from 1st October 2082 to mid-June 2083.
25. The pre-bid meeting will be held at the Municipality office at 1:00 PM on the 7th day from the date of publication of this notice. If that day falls on a public holiday, the meeting will be held on the next day at the same time.
