As per Sub-section 2 (d) 1 and (d) 6 of Section 11 of the Local Government Operation Act, 2074, the following internal revenue related contract arrangements have to be made for Mandandeupur Municipality for the fiscal year 2082/83, the rates passed by the Provincial Finance Act and the approved Environmental Impact Assessment (EIA) area determination report for the Indravati River and the Chakhola/Aanshikhola and
This notice is published to invite interested individuals, firms or companies interested in obtaining the contract for the collection and sale of gravel, stone, sand, gravel from the areas mentioned in the Preliminary Environmental Examination Report (IEE) for Dhandkhola/Tharkhola River, not exceeding the approved quantity, to submit bids within the following subject areas, not less than the minimum number specified as per the details. No action will be taken on bids received after the due date or after the deadline.

Contract terms and conditions:

1. While purchasing the bid form, the bid form can be purchased within the office hours of 2082/05/04 by attaching a copy of the Nepali citizenship certificate, personal PAN registration certificate in the case of an individual and a copy of the updated firm renewal certificate, tax payment certificate for the fiscal year 2080/81, as well as a written application, self-declaration letter and a copy of the C.A. tax registration certificate.
2. While purchasing the bid form for E-Bidding, the Bid document can be downloaded from www.bolpatra.gov.np by attaching a copy of the Nepali citizenship certificate, personal PAN registration certificate and updated firm renewal certificate for individuals, a copy of the tax payment certificate for the fiscal year 2080/81, as well as a written application, self-declaration letter and a copy of the VAT registration certificate within 12 noon on 2082/05/05.
Bid forms can be purchased by depositing the bid fee in Account C.1.1 Internal Revenue Account Mandandepur Account No. 22004010000010, Revenue Heading No. 14229 at Global IME Bank Kuntavesi Branch.
3. The bid forms purchased as per point no. 1 and 2 shall be duly filled in and submitted to the office and E-submission shall be made by 12:00 PM on 2082/05/05 respectively. The submitted bids shall be opened at 2:00 PM on the same day in the presence of the bidders or their authorized representatives and office representatives present at the office. There shall be no impediment to opening the bids even if the bidders or their representatives are not present. While submitting the bid through E-submission, the documents mentioned in point no. 2, bank guarantee, bid fee, Bid Response document in PDF Format shall be submitted.
4. 5. Deposit Amount: Although the amount specified in www.bolpatra.gov.np is 5% of the minimum score for the financial year 2082/83, the bidder must deposit 5% of the amount including VAT that he/she has promised while submitting the bid.
The bid validity period must be at least 90 days.
The deposit amount to be paid in percentage shall be deposited in the account C.3 Mandandepur Deposit Account No. 22004010000008 of this office at Global IME Bank, Kuntavesi Branch, in the form of an original bank voucher or an original bank guarantee letter (Bid security) issued in favor of this office by a commercial bank recognized by the Government of Nepal with a validity of at least 120 (one hundred and twenty) days from the last date of bid registration.
6. When filling out the bid, the amount you have bid must be clearly written in figures and words. If the amount written in figures and words differs, the amount written in words will be accepted.
7. Within 7 (seven) days from the date of receipt of information regarding the acceptance of the bid, 30 (thirty) percent of the bid amount (including VAT) shall be paid in cash and the remaining amount shall be paid in Nepal in favor of this office.
Each installment amount (including the amount for CIT) issued by a government-recognized commercial bank will have to be accompanied by a separate performance bond.
8. The contractor shall be entitled to collect fees only at the rates specified in the subject area specified in the contract. The rates of collection and sales fees shall be provided with the bid form.
9. If the Bagmati Province Government changes the rates at any time, it will be implemented accordingly. Also, information regarding this will be provided immediately from this office.
10. In addition to the rivers/streams mentioned in this notice, in case of sale of construction materials used for development projects operated by the Government of Nepal/donor agencies, as per the decision of the Government of Nepal, Council of Ministers dated 2072/10/20, the municipality will recover the sale price from the concerned project based on the quantity used by the concerned project (within the scope of the approved IEE).
11. If any dispute arises between the contractor and the office regarding the contract, the Mandandepur Municipal Executive will decide to resolve it.
12. The contractor shall be solely responsible for collecting and collecting sales fees. The office shall not bear any responsibility in this regard and the contractor shall be responsible for paying all other taxes payable under the prevailing laws, except VAT on the contract amount.
13. Gravel, stone, sand, gravel: In the contract for the sale of gravel, stone, sand, gravel, it is not allowed to be extracted in a way that damages private land. In addition, at least 500 meters above the bottom of the bridge over the river/stream
Gravel, stones, sand, and gravel should be removed only from the locations specified in the report.
14. Since the quantity of goods is fixed in the contract and the contract is invited according to the quantity, the quantity can be sold even in a shorter period after completing the necessary procedures. Also, since the contract agreement is made on the basis of quantity, no compensation will be given in case the work is not resumed for a few days due to strike etc. Except for the period mentioned in the EIA/IEE report, materials will not be allowed to be excavated from the river/stream, but there will be no obstacle in selling the materials stored in piles at various places.
15. If the law and standards are not met during district monitoring and monitoring by municipalities and related government agencies, action will be taken in accordance with the prevailing law.
16. The contractor must remove the excavated stone, gravel, sand, and gravel from the area within the fiscal year for which the contract agreement was signed.
17. No stone, gravel, sand, or gravel may be excavated in a manner that changes the direction of river flow.
18. Riverine materials shall be excavated only from the locations mentioned in the report. Also, if approved in the report, there will be no obstacle to excavating riverine materials using machines for the approved period.
19. Cold sand washed with water cannot be transported on blacktop roads with water leaking out. Also, when transporting stones, gravel, sand, and gravel, they must be transported only by covering them. Also, the muddy water produced when washing sand cannot be directly mixed into the river.
20. No demand for discount/waivers of the contract amount will be accepted by the office under any circumstances. However, the annual contract amount quoted shall be paid in full at the time of signing the contract.
If deposited, a discount will be given as per the decision of the municipal executive, within the scope of prevailing laws and regulations.
22. Other matters not mentioned herein shall be as per the Riverine Materials (Extraction and Utilization) Procedure, 2075 BS and the Standards for Stone, Ballast, Sand Excavation, Sale and Management, 2077 BS, the Standards for Stone, Ballast, Sand Excavation, Sale and Management (First Amendment) Procedure, 2079 BS, the Procedure for the Use and Management of Riverine Materials within Mandandepur Municipality, 2072 BS and other prevailing laws. In addition, the environmental study report prepared by this office at the time of signing the agreement shall be considered an integral part of this bid.
21. The office reserves the right to accept or reject any bid received.
23. Receipts that have been certified and issued by the municipality office and are yet to be issued must be returned. Receipts will be certified a second time only after eighty percent of the receipts issued for the first time are returned.
24. The contract period will be from 1st October 2082 to mid-June 2083.
25. The pre-bid meeting will be held at the Municipality Hall on the 22nd day from the date of publication of this notice at 1:00 PM. If that day falls on a holiday, the meeting will be held on the next day at the same time.
