Notice regarding vegetable and fruit import tax contracts!

Pyuthan Municipality, Municipal Executive Office Pyuthan, in accordance with Schedule 10 C.No. 92 of the Local Government Operation Act 2074 and the approved Financial Act of this Municipality for the Fiscal Year 2082/083, 'D', has to make contract arrangements for the FY 2082/083 by collecting revenue at the rate of 20 paisa per kg with the objective of encouraging local vegetables and fruits by replacing vegetables and fruits imported from outside the area of Pyuthan Municipality. Therefore, interested registered firms and construction entrepreneurs registered under Value Added Tax are requested to purchase the contract bid form form from the Pyuthan Municipal Executive Office by paying a fee of Rs. 1,000/- (non-refundable) and also to clearly state the contract amount in figures and words and to sign the sealed bid form with the contract amount of Rs. The amount to be paid at the rate of 5 percent of the amount including tax is to be deposited in the name of this office at Nepal Bank Limited Bijuwar Branch, G 3.1 Pyuthan N.P. Local Level Deposit Account No. 281030000000001 and the bank voucher attached. This notice has been published for the information of all concerned to submit sealed bids by themselves or through their representatives within 12:00 on the specified day. All rights to reject or accept the submitted bids are reserved by this municipality. For further information, please contact the Revenue Branch of Pyuthan Municipality during office hours. Date, Time and Place of Opening of Sealed Bids: Bids submitted within the stipulated time on 2082.05.14 at 2:00 PM will be opened in the presence of the bidders and their representatives at the office of Pyuthan Municipal Executive, Bijuwar. Even if the bidders or their representatives are not present, there will be no obstacle in opening the submitted bids.
Conditions and Restrictions:
1. The instructions issued from time to time by the federal, provincial governments, and municipalities must be followed.
2. If any dispute arises between the contractor and the municipality office regarding the terms and conditions of the contract, the decision of the municipality shall be final and binding. No complaint shall be entertained by the contractor in this regard. When the bid is accepted and the agreement is made, the terms and conditions as per the Act and Rules shall also be kept.
3. While purchasing the tender form, a copy of the firm registration certificate, permanent account number (including value added tax registration) and tax payment certificate for the financial year 2080/081 must be submitted.
4. The contractor will have to bear the VAT, income tax and any other taxes, fees and charges related to this income contract.
5. At the time of contract agreement, the total amount due, including 50 percent of the contract amount, advance income tax, and CIT, will have to be deposited in a lump sum. The remaining 50 percent amount will have to be paid in an approved bank guarantee (performance bond) valid until mid-2083 Paush. The remaining 50 percent amount, including CIT and advance income tax, will have to be paid by mid-2082 Chaitra.
6. If the specified installment is not paid within the deadline, a penalty of 10 percent will be levied as per the rules.
7. If there is a discrepancy between the numbers and letters written in the bid, the letters will be accepted. No action will be taken against the bid that contains any conditions and is not in compliance with the rules.
8. After the contract is approved and the agreement is signed, no claim for waiver of the contract amount can be made in the event of a man-made shutdown such as a strike, except in cases where the contract is interrupted by a decision of the federal and provincial governments, municipalities, or courts.
9. If the last day for submitting income contract forms falls on a public holiday, the purchase and submission of bids can be done on the next day when the office is open, at the specified time.
10. The terms and conditions mentioned in this notice shall be as per this notice and in case of any other provision, the prevailing law shall prevail.
