Notice of electronic contract invitation for operation of pharmacy of Primary Health Center Shivganj, Health Insurance

As per Section 11, Sub-section 4, Clause B (4) of the Local Government Operation Act 2074, the Shivasatakshi Municipality Office has to arrange the pharmacy operation contract for two years by fixing the minimum contract amount including VAT at Rs. 48,00,000.00 (Forty-two lakhs only) for the financial year 2082/083 and an additional 10 (ten percent) of the total contract amount for the financial year 2083/084. Therefore, a 30-day bid has been invited, not to be less than the minimum contract amount mentioned in the terms and conditions mentioned in the contract documents.

Conditions:
1) Interested and eligible bidders, while submitting the documents, should attach a copy of the licensed firm or company registration certificate, a copy of the renewed registration certificate, a certified copy of the VAT registration certificate and the tax payment certificate for the financial year 2080/81 along with a self-declaration form and deposit the prescribed bidding paperwork fee of Rs. 3000.0 in cash (non-refundable) in the name of this municipality in the Internal Revenue Account No. C-1-1 (29601400000017) at Nepal Investment Mega Bank, Shivasatakshi Branch and submit the voucher and the above-mentioned documents by scanning it.
2) Bidders submitting bids shall deposit 3 percent of the bid amount in cash in the name of this office in Nepal Investment Mega Bank, Byddada Branch, Deposit Account No. C-3 (29601400000048) and submit the scanned voucher or submit a bid bond with a validity of 120 days issued in the name of this office by a commercial bank or financial institution.
3) If the date of submission and opening of bids falls on a public holiday, the deadline for submission and opening of bids will be set on the next day, the office will be open on the date and time mentioned above.
4) The bid must be submitted in the name of the firm in whose name the purchase was made.
5) The office reserves the right to accept or reject any or all bids, in whole or in part.
6) The bidder will have to come to this office to sign the agreement within 15 (fifteen) days from the date of publication of the notice of acceptance of the bid. If the agreement is not signed and the contract is not taken within that period, the deposit amount will be confiscated and necessary legal action will be taken.
7) The approved contract amount at the time of contract agreement will have to be paid in a lump sum of 13 percent VAT plus the first year's advance.
8) If the contract bid amount is paid in one lump sum, there will be a 10 (ten) percent discount on the total amount.
9) If the amount is to be paid in installments, the first 50 percent of the amount must be paid before signing the contract. The remaining 50 percent must be paid within 3 months of signing the contract.
10) If the entire amount is to be paid in one lump sum in installments, the bidder will have to submit a bank guarantee equal to the amount remaining to be paid when the contract is signed, from a "A" class commercial bank recognized by Nepal Rastra Bank, for the duration of the contract, before signing the contract.
11) In the course of contract implementation, all other taxes, duties, fees, etc. payable to the Government of Nepal, Provincial Government and local level as per prevailing laws and regulations shall be paid by the contractor himself to the concerned office.
12) The contractor shall not be allowed to terminate the contract during the contract period. If the contractor terminates the contract in the meantime, the amount due from him shall be recovered by adding 10 percent interest to the amount due. If the contract is terminated in this way and the amount due from him is less than the amount agreed upon during the contract or other arrangements for the remaining period, the less amount shall also be recovered from the former contractor as a government due.
13) In addition to the above-mentioned conditions, the prevailing Nepal law shall apply in all cases.
