Sub-section (2) of Section 10 of the Public Procurement Act, 2063, the bidders/sealed tenderers must have performed the work satisfactorily (no administrative action such as warning letter, work improvement letter, contract suspension, predetermined compensation, contract termination, recommendation for blacklisting, etc.) if they have carried out construction work in the bodies under the Nepal Army in the past 2 fiscal years (2079.80 and 2080.81).

2. The bidder/sealed tenderer shall visit the site at his own expense. In case of not visiting the site, a commitment letter stating "I agree/agree to carry out the construction work wherever and however the construction site is located" shall be submitted while submitting the bid/sealed tender.

3. As per Sub-rule 1 (c) of Rule 123 of the Public Procurement Regulations, 2064, the concerned construction entrepreneur will be paid the running bill on the basis of completion of the milestones set for the construction work. In addition, the concerned construction entrepreneur will have to mandatorily submit the necessary documents including the bill/invoice for payment within 15 days of completion of each milestone.

4. In accordance with subsections (7) and (8) of Section 59 of the Public Procurement Act, 2063, if the construction entrepreneur does not commence the work as per the agreement, if he/she abandons the work before it has started or if the work does not progress as per the agreement, such agreement shall be terminated at any time and the entire security shall be forfeited. It is also notified that any amount required to complete the remaining work as per the agreement due to the termination of the agreement shall be recovered from the construction entrepreneur who does not perform the work as per the agreement as a government due.

5. The revenue voucher for purchasing the bid/sealed bid form must be submitted.
