Notice regarding invitation to bid for contract arrangement for advertisement tax collection work within the jurisdiction of Siddharthanagar Municipality.

Since income contract arrangements are required for the collection of advertisement tax on advertising materials (hoarding boards, glow sign boards, flex beds, digital boards, banners, etc.) placed within the Siddharthanagar Municipality area, for the fiscal year 2082/083 to 3 fiscal years, this notice has been published for interested firms/companies to submit electronic bids subject to the Local Government Operation Act, 2074, Advertisement Tax Regulations, 2076, Siddharthanagar Municipality Outdoor Advertisement Regulation Directive, 2081, Municipality Finance Act, 2082 and the conditions as specified.

Bidding Fee - Bidding form fee of Rs. 3,000/- (non-refundable) can be purchased and registered electronically from the website of the Public Procurement Monitoring Office www.bolpatra.gov.np/egp by depositing the amount in the name of this office in the account no. C-1-1-04-01145634-20-8 or online from the portal sutrarevenue.fcgo.gov.np and attaching the license with renewal, registration certificate, copy of the value added tax registration certificate, and copy of the tax payment certificate for the fiscal year 2080/081, within 12.00 pm on Bhadra 24, 2082.

The registered bids will be opened on the same day at 12.15 PM in the presence of the bidder or his representative. There will be no impediment to opening the bids even if the bidder or his representative is not present. If the day on which the bids are to be purchased, submitted or opened falls on a holiday, the bids will be purchased, submitted and opened on the next day or on the day the office is open, respectively, at the above-mentioned times.

Deposit/Guarantee - While submitting the bid, an amount equal to 5 (five) percent of the total amount including value added tax to be bid shall be deposited as a deposit in the form of an original bank voucher deposited in the Agricultural Development Bank Ltd. Branch Office Siddharthanagar, Deposit Account No. (C-3) 04-146-01145634-03-8 or a bid bond (bid security) with a validity of at least 120 days issued by a recognized commercial bank in the name of Siddharthanagar Municipality.

The bid form should not contain any conditions on the part of the bidder or any additions, deletions or notes to the details mentioned.

Duration - The contract period will be for three fiscal years from Shravan 1, 2082 to mid-Ashar 2085.

Necessary information related to the bid can be obtained from the Revenue Administration Branch of the municipality before registering the bid.

Bidders with firms having permanent addresses within this municipal area must mandatorily submit a copy of their business tax registration certificate with the municipality. In the case of firms wishing to purchase the bid, they must submit their application by attaching a copy of their renewed certificate registered with the concerned authority.

Agreement - After the acceptance of the bid, the bidder will be given a period of 7 days excluding travel time to enter into the agreement as agreed. While entering into such an agreement, the date of receipt of the letter or publication of the notice or sending of the official email of the office will also be counted. If the bidder does not appear for the agreement within the notice period or does not agree to enter into the agreement as agreed, the deposit/surety amount of the bidder will be confiscated and he will be blacklisted and his

Security and Installment - After the bid is accepted, the bidder will have to deposit 25 percent of the approved contract amount including value added tax in cash at the time of contract agreement, and the remaining 75 percent can be deposited in the form of a performance security or cash amount valid for an additional 15 days (until Shrawan 15, 2085) from a commercial bank recognized by Nepal Rastra Bank, including the contract period.

The amount agreed upon as per the agreement shall not be reduced or deducted for any reason. However, if the annual contract amount is paid in advance or in a lump sum, it shall not be deemed binding to grant a discount of five to ten percent, based on the decision of the municipal executive, based on justification.

The annual amount of the contract amount shall be divided into three installments quarterly and paid in installments by the middle of Kartik, Falgun and Asar respectively. The amount deposited in cash at the time of the agreement shall be calculated as an installment and deducted from the quarterly installment to be paid. If the amount of each installment is not deposited by the middle of the quarter, a notification shall be made by the fastest means to deposit the amount. In this way, if the amount is not deposited by the 7th of the next month, an additional 10 percent penalty shall be imposed on the amount to be paid. Even if the penalty is imposed, if the installment amount is not deposited within that month, recovery shall be made from the deposit/guarantee amount. If the installment amount is repeatedly not paid on time, the contract may be cancelled by recovery from the bank guarantee.

When paying the installment amount, the value-added tax and income tax must be paid in advance and a voucher must be provided.

The rate of advertisement tax shall be as prescribed in the financial act issued by the municipality annually. Fees shall not be collected beyond the prescribed rate. In the event that a complaint is received and it is proven during investigation that fees have been collected beyond this condition, a fine of Rs. 10,000 will be imposed for the first time after clarification is sought, and for the second time, action will be taken up to and including cancellation of the contract and forfeiture of the bank guarantee.

No action will be taken against the bids submitted with conditions or incomplete/expired. The Company reserves the right to accept/reject the bids without assigning any reason.

The rate of advertisement tax will be as prescribed in the Municipal Finance Act, 2082.

The matters mentioned in the bid form and this notice shall be as per this and other matters/subjects shall be as per the Local Government Operation Act, 2074, Public Procurement Act, 2083 and Regulations, 2064, Siddharthanagar Municipality Internal Revenue Collection (Contract Arrangement) Procedure, 2078, Advertisement Tax Regulations, 2076, Siddharthanagar Municipality Outdoor Advertisement Regulation Directive, 2081 and prevailing laws.
