As per the Local Government Operation Act, 2074, Siddharthanagar Municipality Finance Act, 2082 and Internal Revenue Collection (Contract Arrangement) Procedure, 2078, interested and eligible firms/companies/organizations are required to make contract arrangements for the current fiscal year to collect entry and parking fees within Siddhartha Bus Park.

This notice is published for the submission of sealed bids or electronic bids subject to the following conditions.

1. Bidding Fee - Bidding form can be purchased from the Revenue Administration Branch for a fee of Rs. 3,000/- (non-refundable). Those who wish to submit their bids electronically should deposit the amount in the name of this office at the Agricultural Development Bank Ltd. Bhairahawa Branch Office. Account No. C-1-1-04-146-01145634-20-8 or online through the portal sutrarevenue. fcgo.gov.np and in the case of a firm/company/organization, a copy of the license with renewal for the current fiscal year, registration certificate, value added tax registration certificate, a copy of the tax payment certificate for the fiscal year 2080/081 and in the case of a local firm, a copy of the tax payment certificate for the fiscal year 2080/081 and in the case of a local firm, a copy of the tax payment certificate for the fiscal year 2080/081 to the municipality. Bid forms can be purchased from the Revenue Administration Branch within office hours on Bhadra 24, 2082 by attaching a self-declaration that there is no outstanding amount due until 2081/082, that there is no action taken in public procurement work, and that there is no blacklist/negative list, or that the bid can be purchased and registered electronically from the Public Procurement Monitoring Office website www.bolpatra.gov.np/egp by 12.00 pm on Bhadra 25, 2082.

2. Bids registered before 12:00 PM on 2082/05/25 will be opened at 12:30 PM on the same day in the presence of the bidder or his representative. There will be no impediment to opening the bids even if the bidder or his representative is not present. If the day on which the bids are to be purchased, submitted or opened falls on a holiday, the bids will be purchased, submitted and opened on the next day or on the day the office is open, respectively, at the above-mentioned times.

3. While submitting the bid, a bid bond (bid security) of 5 (five) percent of the total amount including value added tax to be submitted shall be submitted in the form of a bank voucher or a bid bond (bid security) with a validity of at least 120 days issued by a recognized commercial bank in the name of Siddharthanagar Municipality, deposited in the Agricultural Development Bank Ltd. Branch Office of this office, Siddharthanagar, Deposit Account No. (C-3) 04-146-01145634-03-8.

4. The bidder should not include any conditions in the bid form or make any additions, deletions or comments to the details mentioned.

5. Duration - The contract period will be for 1 year, calculated from the date of signing the agreement.

6. If an organization wishes to participate in the competition, the organization's statute/regulations must state its purpose of working in the transportation sector or participating in contract competition.

7. Before registering the bid, necessary information related to the bid can be obtained from the Revenue Administration Branch of the municipality.

8. Bidders with a firm having a permanent address within this municipal area must submit a copy of the municipal business tax registration certificate. In the case of a firm wishing to purchase a bid, a copy of the certificate of registration and renewal with the concerned body must be attached to the bid.

Agreement - After the acceptance of the bid, the bidder will be given a time of 7 days excluding the travel time to enter into the agreement as per the offer. While making such correspondence, the date of receipt of the letter or publication of the notice or sending the email from the official address of the office will also be counted. If the bidder does not appear for the agreement within the notice period or does not agree to enter into the agreement as per his offer, the deposit/guarantee amount of the said bidder will be confiscated and he will be blacklisted and the bids following him will be selected as per the decision of the office.

10. After the bid is accepted, the bidder will have to deposit 25 percent of the approved contract amount including value added tax in cash at the time of contract signing, and the remaining 75 percent can be deposited in a performance bond or cash from a commercial bank recognized by Nepal Rastra Bank with a validity of 30 days including the contract period.

11. The amount agreed upon as per the agreement shall not be reduced or deducted for any reason. However, if the annual contract amount is paid in advance or in lump sum, it shall not be deemed binding to grant a discount of five to ten percent, based on the decision of the municipal executive, based on justification.

12. The annual amount of the contract amount shall be divided into three installments on a quarterly basis and paid in installments by the middle of the quarter. The amount deposited in cash at the time of the agreement shall be counted as the first installment. If the amount of each installment is not deposited by the middle of the quarter, a notification shall be made by the fastest means to deposit the amount. In this way, if the amount is not deposited by the 7th of the next month, an additional 10 percent penalty shall be imposed on the amount due. Even after the penalty is imposed, if the installment amount is not deposited within that month, the contract shall be cancelled by recovering it from the deposit/guarantee amount.

13. When paying the installment amount, the value added tax and income tax must be paid in advance and a voucher must be provided.

14. The rate of bus park entry and parking fees shall be as prescribed in the financial act issued by the municipality annually. Fees shall not be collected beyond the prescribed rate. In the event that a complaint is received that fees have been collected beyond this condition and it is proven during investigation, a fine of Rs. 10 shall be imposed upon the first request for clarification.

A fine of Rs. 10,000 will be imposed and action will be taken up to and including cancellation of the contract and forfeiture of the bank guarantee for the second time. 15. No action will be taken against the bids submitted with conditions or without giving reasons. The Municipal Executive Office reserves the right to accept or reject the bids without giving reasons.

16. The rate of Siddhartha Bus Park entry and parking fee will be as prescribed in the Municipality Finance Act, 2082.

17. The matters mentioned in the bid form and this notice shall be as per this and other matters/subjects shall be as per the Local Government Operation Act, 2074, Public Procurement Act, 2063 and Regulations 2064, Siddharthanagar Municipality Internal Revenue Collection (Contract Arrangement) Procedure, 2078 and prevailing laws.
