15-day notice regarding the contract termination if the work is not performed

Under this office, the contract No. NCB-01/2081/082, the construction of Shri Janata Adharbhut School building was awarded to this municipality and construction entrepreneur Shri Vikas-Raja J. on 2081.10.28 with the completion date of 2082.03.15. In the contract agreement between the two parties, the work could not be completed on time due to various reasons and the deadline was extended for the first time and the date was to be completed by mid-2082 Paush. Since APG, PB and Insurance have not submitted any documents after the extension and there has been no physical progress, it is difficult to conduct teaching and learning in the school and leaving the construction work incomplete in a sensitive area like the school will negatively affect the students. Considering this issue, despite repeated written and verbal requests from this office on various dates, no documents have been submitted and no progress has been made and no interest has been shown in completing the work. Therefore, this notice has been published to request an official representative to appear in this office with a revised work schedule, a reliable plan for resource mobilization, a commitment to complete the work and a reasonable reason not to terminate the contract, if any. If the contractor does not show readiness to start the work within the above period, action will be taken to terminate the contract and blacklist it as per the provisions of Sub-sections 7 and 8 of Section 59 of the Public Procurement Act 2063 BS and Rule 128 of the Public Procurement Regulations 2064 BS and the GCC of the contract agreement. It is also informed that action will be taken to perform the work as per the rules, confiscate the deposit amount and recover the remaining expenses incurred for the work as government dues.
