Restaurant rental income contract

Notice of Tender Invitation

This notice has been published as it is necessary to operate and manage through the private sector for a period of 5 years a fully equipped restaurant (restaurant) with an area of 1600 square feet, including a kitchen, a washing area, tap water, electricity, fans, toilets, a fully equipped east and south facade and an open kitchen with a fence of 12 mm Toughened Glass on the ground floor of the Lumbini Bus Terminal Shopping Complex located in Ward No. 9, owned by Butwal Sub-metropolitan City, and a fully equipped two-storey restaurant (restaurant) with an area of 944 square feet, with a counter, kitchen and store on the newly constructed ground floor on the east south edge of the Jitgadhi Fort complex, and a dining hall with cabins on the first floor surrounded by glass (12 mm Toughened Glass). This notice inviting bids has been published for the information of all concerned to submit formal bids through electronic means (e-Bidding) from firms and companies licensed by the Government of Nepal (whose certificates have been renewed as per the rules) who are interested in operating and managing the above-mentioned restaurants.

Terms, Conditions and Provisions:

1. To purchase the bid electronically, the bidder can deposit a bid fee of Rs. 1000/- (One thousand rupees only) (non-refundable) in the internal account of Rastriya Banijya Bank Butwal Branch, Butwal Sub-Metropolitan City Office Code No. (801054801) 31201003010002 or can be obtained by downloading the PPMO from the website: http//www.bolpatra.gov.np.

2. Bids (E-Submitted) must be submitted by 12:00 PM on 2082.04.30. The same day, at 1:00 PM, the bids will be opened at the office of the B.U.M.N.P.A. Municipality. There will be no obstacle to opening the bids even if the bidder or his representative is not present.

3. The contract period will be 5 years and the rent will increase by 5 percent every year from the second year onwards. After the contract period ends, the rent will be re-arranged through a competitive process.

4. The bidder shall submit the bid bond along with the bid deposit amount mentioned in the details in the name of Butwal Sub-Metropolitan City in the name of R.W. Bank Khasyuli Branch, Deposit Account No. 31201003000002, in the form of a bank voucher, cash or a bank guarantee letter (bid bond) issued in the name of B.U.M.N.P.A.K. with a validity of at least 90 days from the last date of submission of bids.

5. The bid of the bidder who has completed the prescribed process and has offered the highest amount will be accepted.

6. After the bid is accepted, a deposit amount of 5 percent of the total rental amount for 5 years of the rental amount agreed upon shall be deposited in the name of Butwal Sub-Metropolitan City in the name of R.W. Bank Khasyuli Branch, deposit account No. 31201003000002, along with the original bank voucher and the monthly rental amount for the first month and the specified advance rental amount at the time of signing the agreement. The advance amount will be deducted from the monthly rental of the last year of the rental agreement.

7. If the bidder fails to sign the contract along with the deposit and the specified advance rental lump sum or voucher deposited in the municipality's bank account within 7 days from the date of receiving the information that the bid has been accepted, the deposit submitted with the bid will be confiscated and the process will be taken forward as per the rules.

8. Firms or companies that currently have outstanding dues to Butwal Sub-Metropolitan City will not be allowed to purchase or submit bids. Bids submitted in this manner will not be included in the evaluation.

9. While the place for which the bid is invited has been prepared and equipped with all the necessary infrastructure for operating a restaurant, the lessee will not be allowed to operate any other business except the restaurant and will not be allowed to let a third party do the business by making an agreement and will not be allowed to rent out the space by making a partition. If such an act is found to be done contrary to the agreement, the rental agreement will be canceled.-

10. Detailed details of other terms and conditions are mentioned in the bid form. For further information, you may contact the Natural Resources and Property Management/Revenue Administration Branch of the Butwal Sub-Metropolitan City Municipal Executive Office.

11. Butwal Sub-Metropolitan City reserves the right to accept/reject the bid with or without assigning any reason.

12. Value Added Tax will not be levied on the monthly rent. The bidder himself will have to pay other taxes as per the prevailing laws and regulations to be paid to the Government of Nepal.

13. Other matters will be in accordance with the Local Government Operation Act 2074, the Public Procurement Act 2063, the Public Procurement Regulations 2064, the Regulations on the Settlement of Income Contracts 2076, and the prevailing laws and regulations.
