Notice regarding invitation of sealed bids for collection of riverine product excise tax

As per the provisions of Section 62 (a) of the Local Government Operation Act, 2074 and Section 7 of Schedule 6 of this Koshi Province Economic Act, 2082, riverine materials (stones, ballast, gravel, sand, and sand) have to be excavated from the approved ghats of the rivers mentioned in the schedule in accordance with the criteria for sale and management of stones, gravel, sand, and sand and sold at the rate prescribed by Khandbari Municipality, this notice has been published for the information of all concerned to participate in the bidding process by attaching the certificate of renewal of the firm, value added tax registration certificate, certified copies of tax payment certificate for the fiscal year 2080/081 and Nepali citizenship certificate along with other necessary documents, subject to the conditions as per the schedule.

Contract terms and conditions
1. The bidder shall purchase the bid form from the Khandbari Municipality Office within the office hours of the 15th day from the date of first publication of this notice by submitting an application along with the renewed registration certificate of the firm or company, value added tax registration certificate, certified copy of the tax payment certificate for the fiscal year 2080/081, cash voucher for the bid form fee paid in cash to this office or cash deposited in cash in the Internal Revenue Account No. 20801003010002 of this office at the Rastriya Banijya Bank Branch Office, Khandbari. The bidder shall have to purchase the bid form from the Khandbari Municipality Office within the office hours of the 15th day from the date of first publication of this notice. The prescribed bid fee shall be deposited in this office or in the bank account of this office in the above-mentioned account No. along with the bid related documents. If the last day for submission of bids falls on a public holiday, the said work shall be done on the next office opening day immediately thereafter.
2. While filling the bid form, the bid amount should be clearly mentioned in words and figures. In case of difference in figures and letters, the letters will be accepted. The above mentioned deposit amount should be deposited in the deposit account No. 20501003000002 of this office at the Rastriya Banijya Bank branch office, Khandbari and its original bank voucher or a bid bond issued in the name of this office from a commercial bank or financial institution licensed by Nepal Rastra Bank, mentioning the bid number and name, with a validity period of at least 120 days, should be submitted.
3. The bidder must fill in all the details mentioned in the purchased bid forms, sign each page and submit it to this office by 12:00 PM on the 16th day from the date of first publication of the notice.
4. Bids purchased in the name of one firm or company cannot be submitted in the name of another firm or organization. Bid documents submitted in a proper manner will be opened at this office from 14:00 on the last day for submission of bid documents in the presence of representatives of various offices, construction entrepreneurs or their representatives. Also, if the bidders or their representatives are not present on time, there will be no impediment to opening the bids. If the said day falls on a holiday, the work will be done on the next day when the office is open.
5. Detailed information regarding the bid is mentioned in the bid form and can be obtained from the same booklet or by contacting this office. This office will not be bound to accept bids submitted after the deadline, without formalities or with conditions. This office reserves all rights to accept or reject bids.
6. If the bid is accepted, the first installment of 50 percent of the bid amount must be paid within 15 days of the date of receipt of the notice or the date of posting the notice at the door along with the VAT registration certificate. The second installment of 50 percent must be paid by submitting a bank guarantee (performance bond) issued by a commercial bank or financial institution licensed by Nepal Rastra Bank in the name of this office with a term of up to mid-Jestha 2083 BS and collecting the lease. In addition, if the bid amount is made to the municipality in lump sum, a discount of up to 10 percent will be given and the firm bidding for the bid will have to pay an additional 13% VAT to this office as per the rules on the total amount to be paid for the bid amount and service fee. As per the rules, the bidder will have to pay income tax and other taxes separately to the Government of Nepal.
7. If the lease is not collected within the specified time, the deposit amount will be confiscated and the bid will be settled as per the rules. The mining area and mining volume of the rivers and streams of this municipality will be in accordance with the Local Government Operation Act, 2074, laws issued by the concerned local level, provincial laws and prevailing laws or standards.
