In accordance with Section 11, Sub-Section 2, Clause D (6) of the Local Government Operation Act 2074, the Madi Municipality, Municipal Executive Office has invited interested individuals or firms/companies to submit their bids within the specified period for the collection and sale of stones, gravel, sand, mixed gravel and soil/burlap from rivers, streams and drains at the rates approved by the Municipal Executive, excluding Chure and forest areas.

Contract terms and conditions:

Collection, sale and distribution of misket

1. While purchasing the bid form, the firm/company shall submit the firm registration certificate, renewed registration certificate, certified copy of value added tax and tax payment of FY 081/082, gross voucher of the bid form fee paid in cash to this office or cash deposited in the Internal Revenue Account No. C1.1 06006732080084 of this office at Himalaya Bank Ltd., Branch Office Madi along with the application and purchase from this office within the office hours of the 15th day from the date of first publication of this notice. Also, the bidder shall attach the voucher of depositing the prescribed bid fee in this office or the bank account of this office in the above mentioned account number along with the bid related documents. If the last day of submission of bids falls on a public holiday, the said work shall be done on the next working day after that.

2. While filling the bid form, the bid amount should be clearly mentioned in words and figures. In case of difference in figures and letters, the letters will be accepted. The above mentioned deposit amount should be deposited in the deposit account No. G3.1 06006732080034 of this office at Himalaya Bank Ltd., Branch Office Madi and the original bank voucher or a bank guarantee (bid bond) with a validity of at least 120 days from a commercial bank licensed by Nepal Rastra Bank under the name of this office, mentioning the bid number and name.

3. The bidder shall fill in all the details mentioned in the purchased bid forms and sign all the pages on the 16th day from the date of first publication of the notice.

It must be submitted to the office by 12:00 PM.

4. Bids purchased in the name of one firm or company cannot be submitted in the name of another firm or organization. The bid documents will be opened at this office at 14:00 on the last day for submission of the bid documents in the presence of representatives of various offices, construction entrepreneurs or their representatives. Also, if the bidder or his representatives are not present on time, it will not be considered as an obstacle to the opening of the bids. If the said day falls on a holiday, the work will be done on the day when the office is open immediately after the holiday.

5. Detailed information regarding the bid is mentioned in the bid form and can be obtained from the same booklet or by contacting this office. This office will not be bound to accept bids submitted after the deadline, without the required formalities or with conditions. This office reserves all rights to accept or reject the bids.

6. If the bid is accepted, the first installment of 50 percent of the bid amount must be paid to the account of this office, Account No. C6.1 06007632080061, along with the VAT registration certificate, within 15 days from the date of receipt of the notice. The second installment of 50 percent must be paid by submitting a bank guarantee (performance bond) issued by a commercial bank licensed by Nepal Rastra Bank in the name of this office with a term of up to the end of Shravan 2083 BS. In addition, the firm/individual bidding for the bid amount, service fee, and 13% VAT and 1.5% advance income tax as per the rules of the total amount to be paid, must be paid to the revenue account of the concerned Taxpayer Service Office and submitted along with the receipt at the time of signing the agreement. As per the rules, the bidder will have to pay income tax and other taxes separately to the Government of Nepal. If an agreement is made to pay the first installment and the second installment by Baisakh 15, the equivalent amount will have to be paid in cash. Also, if the contract amount is paid in a lump sum, the performance bond mentioned above will not be required.

7. If the agreement is not reached within the specified time, the deposit amount will be forfeited and an agreement will be made with the second party as per the rules. The excavation area and excavation volume of the rivers and streams of this municipality will be in accordance with the Local Government Operation Act, 2074, laws issued by the concerned local level, provincial laws and prevailing laws or standards. In addition, the Preliminary Environmental Study Report (IEE) conducted by this office will be considered an integral part of this bid agreement.
