As per the provisions of Section 64 Sub-section 1, Clause C and Section 11 Sub-section (2), Clause D (6) of the Local Government Operation Act, 2074, the contract has to be arranged in the area and section mentioned in the schedule in the amount determined by the approved Initial Environmental Examination (IEE) in the year 2082/083, therefore, this notice has been published for the information of all concerned to participate in the bidding process by the eligible interested firms or companies who have completed the legal process and are subject to the conditions as per the schedule. You are requested to download the Bid Document from the PPMO website http://www.bolpatra.gov.np and submit your bid through E-bidding within 12:00 PM on the 16th day, without reducing the minimum price within the specified time limit from the date of publication of the notice. Conditions:
1. Bidding documents can be downloaded from the website of the Public Procurement Monitoring Office www.bolpatra.gov.np/egp within the office hours until the last date for submission of bids. For this, Rs. 10,000.- (Ten thousand rupees only in words) (non-refundable) bank voucher filled in at the above-mentioned bank and a scanned copy (pdf format) of the voucher should be submitted along with the bid documents while submitting electronically.
2. Along with the bid form, the amount of bid security, which will be 5 percent of the total bid amount, should be deposited in the deposit account No. 32604010000004 of this office, Global IME Bank Ltd. Sankhu. The original voucher or bank guarantee (Bid Bond) of a bank or financial institution recognized by Nepal Rastra Bank and valid for at least 120 days from the date of issuance of the notice should be scanned and uploaded in PDF format and attached. Also, the renewed license certificate of the firm or company, VAT registration certificate, permanent account number registration certificate and tax payment certificate of FY 2080/081 should be scanned and uploaded in PDF format and submitted electronically from the website of the Public Procurement Monitoring Office www.bolpatra.gov.np/egp within 12:00 on the 16th (th) day.
3. The received bids will be opened on the 16th day at 1:00 PM in the presence of the bidders or their representatives. There will be no impediment to opening the bids even if the bidders or their representatives are not present at the time of bid opening.
4. If the last day for submission and opening of bids falls on a holiday, the time for submission will be up to 12 noon on the next day the office is open and the time for opening the bids will be 1 pm on the same day. 5. The quantity of (riverine mineral material) determined for collection and sale on 082283 will be deposited from this office on 082.083 until the date of agreement.
The contract will be negotiated by setting the contract price based on the agreed rate of the remaining quantity minus the total quantity exported.
6 The total bid amount will be divided into 2 installments. The first installment, 50 percent of the total bid amount (including VAT), will be paid before the agreement is signed. The second installment, 50 percent of the bid amount (including VAT) will be paid by mid-Chaitra 2082.
7. The contractor shall be solely responsible for collecting fees and taxes subject to the rates prescribed by the current Finance Act of the Provincial Government, Bagmati, FY 082.83. The office shall not bear any responsibility in this regard, and the contractor shall himself pay all taxes payable as per the prevailing laws.
In case of any dispute between the contractor and the office regarding the contract, the Shankharapur Municipality will decide to resolve it and the office's decision will be final.
9. If the monitoring committee finds that the monitoring is not carried out in accordance with the law and standards, action will be taken in accordance with the prevailing law.
10. The riverine mineral resources shall be collected by the end of Jestha of the fiscal year 082283 and the contractor shall be able to remove the collected riverine mineral resources from the area by the end of Ashar of the same fiscal year. Also, no compensation exemption shall be claimed for the quantity less than the specified quantity due to human or natural causes.
11. Collection should be done only from the locations mentioned in the IEE report.
12. No exemption or waiver of any kind can be claimed if tax collection work is not ongoing for any reason.
13. This office reserves all rights to accept or reject the bids received.
14. The contractor shall comply with municipal, provincial and federal laws. Other matters not mentioned herein shall be governed by the prevailing laws.
