As per Sub-section 2 (d) (6) of Section 11 of the Local Government Operation Act, 2074 BS and Sub-section 64 (1) (f), the Office of the Municipal Executive of Sundarharaincha Municipality has to conclude a contract for the collection and sale of stones, gravel, sand and barrage from rivers and streams other than Chure and forest areas in the specified areas and checkpoints in the IE in the specified quantity from the streams as per the details, this public notice has been published for all concerned to submit bids through electronic means (E-BID) within the specified period subject to the conditions as per the details.

If the amount specified in the IE report is excavated, further excavation will be prohibited. Also, there is no provision for any impact or discount on the contract amount specified based on the month and day of the fiscal year.

9. The monitoring committee will also monitor whether the excavation has been carried out in accordance with the standards set by the IE. If excavation is found to be contrary to the standards, immediate action will be taken to stop the excavation work and action will be taken as per the rules.

10. The bid amount must be clearly stated in figures and words. The bid amount stated in the bid form must be stated in figures and words.

If there is a difference, the higher amount will be recognized.

11. If a contractor, firm or company requests a discount due to problems caused by natural or man-made disasters such as bandh, strike, earthquake, flood or landslide, no other facilities including discounts will be provided. Also, the contractor will not be allowed to request any tax exemption or waiver.

12. The receipt for collecting the fee shall be printed by the contractor himself and stamped by the office representative on each page and shall be in 3/3 copies, with the title of the contract mentioned in the receipt. Tax shall be collected only by submitting the receipt number to the office. A new receipt will be issued only after submitting 80 percent of such receipts and its accounting details. In addition, the contractor shall be responsible for submitting the accounting details of the issued receipts to the municipality within 15 days.

13. It shall be the duty and responsibility of the bidder to comply with the policies, directives and orders of the Honorable Court, Government of Nepal, Provincial Government, Municipality. If any loss or damage occurs due to compliance with the policy directives or court orders, the contractor shall not be entitled to claim compensation from the Municipality.

Note: The provisions regarding the rates of riverine/stream products shall be as mentioned in Sub-section 1 of Section 7 of the Koshi Province Economic Act, 2082 and Schedule 6 related thereto as follows.

14. The monitoring of the extraction, collection and sale of riverine products will be carried out as per the instructions of the Provincial Monitoring Committee, District Monitoring Committee, District Coordination Committee, and Municipal and Ward Level Monitoring Committees.

15. The rates of taxes, duties, fees and other conditions are mentioned in the conditions and form of the bid. All other taxes, duties, fees, etc. payable to the Government of Nepal, Provincial Government and Local Government as per the prevailing laws shall be paid by the contractor to the concerned body. The amount paid for such shall not be deducted from the contract amount awarded.

16. No collection or storage of goods shall be permitted in a manner that obstructs rivers, streams, canals, roads, or public transportation.

17. The contractor must post a notice board with the rates at the location where the fee will be collected, and the fee collection staff must only collect the fee with an identity card.

18. Riverine materials shall be excavated, collected and sold at the rates prescribed by the provincial government (except for certified stocks). If the charges exceed the prescribed rates, action may be taken as per the rules and the contract may even be cancelled.

19. The excavation area, quantity, technology, method and distance shall be excavated, collected and sold in the quantities specified in the IE report from the points specified.

20. While excavating riverine materials, excavation shall not be permitted within 500 meters to the north and 1 kilometer to the south of bridges over rivers.

21. While excavating and collecting riverine/stream-derived materials, they shall be collected and transported only from designated places/points as prescribed, without causing damage to natural streams, ghats, canals, gullies, gullies, highways, roads, and public places.

22. The Bid Document approved and uploaded by the Municipality will be considered as the Standard Bid Document for this purpose.

23. The bidder shall submit the BoQ number and initials for the excavation and sale of riverine materials approved and uploaded by the municipality. However, if any document uploaded/filled by the bidder mentions his bid number, it will not be an obstacle to taking such bid to the evaluation process based on the principle of public interest.

24. The Municipality will evaluate the bidders who participated in this process as prescribed and invite the highest bidder who is found to be substantially responsive for an agreement. If the mentioned bidder does not come to sign the agreement within the prescribed time, a letter will be sent to the second and third bidders as per the rules for an agreement. If the highest bidders do not come to sign the agreement, their entire deposit amount will be confiscated and a recommendation will be made to the concerned body to blacklist them.

1. Bid form fee (non-refundable) can be paid at the internal office of the Agricultural Development Bank branch office of this municipality, Birat Chowk.

The original voucher deposited in the Revenue Account No. 0601501147630146 or the original voucher deposited in the Revenue Branch of the Municipality Office, a copy of the Firm/Business Registration Certificate of the Firm or Company, a copy of the VAT/PAN Registration Certificate obtained from the Internal Revenue Office, a copy of the Tax Payment Certificate for the fiscal year 2080/081, a self-declaration letter, and a deposit amount not less than 5 percent of the bid amount must be deposited in the Deposit Account No. 0601501147630030 located at the Agricultural Development Bank Branch Office of this Municipality, Birat Chowk, and the original voucher or the bid bond of a bank recognized by the Nepal Rastra Bank with a validity of 120 working days issued in the name of Sundarharaicha Municipality.

2. The bid form and related documents can be downloaded from www.bolpatra.gov.np.

3. Documents including the contract bid form must be submitted online by 12:00 PM on the 31st day from the date of publication of this notice.

The bids will be opened on the same day at 1:00 PM in the presence of the office representatives and the bidders' representatives. The bids will not be opened if the bidders/representatives are not present at the time of bid opening.

4. If the bidder fails to sign the contract within 15 (fifteen) days of receiving the letter or publishing the notice or sending the letter to the official email address after the bid is accepted, the bid security deposit will be confiscated and the accepted bidder will be blacklisted, and action will be taken as per the Sundarharaincha Municipality Internal Revenue Collection (Contract Settlement) Act, 2082.

5. The right to accept or reject the bid of the bidder or to invite bids again/not will be reserved by this office as per the rules.

6. If the bidder pays the entire amount of the contract amount in advance, a discount of 10 percent of the amount of the contract amount excluding VAT will be given. The said amount will have to be deposited in the Sundarharaincha Municipality's Divisible Fund Account No. 0601501147630111.

7. The 13% VAT amount to be paid on the bid amount shall be paid in the form of a voucher/document/proof submitted to the Internal Revenue Service Office at the time of the agreement. Similarly, if the bidder wishes to pay the bid amount in installments, the entire amount shall be paid in two installments. The first installment shall be paid in the form of a voucher depositing 40 percent of the bid amount at the time of the agreement, and the second installment shall be paid in the amount of 60 percent of the bid amount by mid-Magh 2082. A performance bond guarantee of a bank recognized by Nepal Rastra Bank, valid until mid-Falgun 2082, equal to the total amount for the second installment, shall be submitted. If the bidder fails to deposit the amount for the second installment within the period specified in this condition, the contract shall be terminated and the performance bond guarantee submitted by the bidder shall be confiscated without informing the bidder and recovered.

8. The contract period will be from the date of signing the agreement until the end of Jestha 2083 only. If before the specified period

25. After the agreement, if the bidder has to excavate and store the specified quantity within the specified time, it will have to be stored in the specified place and area with the prior approval of Sundarharaincha Municipality. While storing riverine/stream-based materials, storage will not be allowed in the open field or in the riverbed area. The stock of riverine materials stored with the approval will have to be zeroed by the middle of Asad 2083.

26. If the bidder who entered into an agreement from mid-June 2082 to mid-June 2083 or the person/firm/company who has purchased riverine materials and has become eligible to stock them within that period or later as per other laws has to verify the quantity of stock (Stock Verification), the stock of riverine/riverine materials remaining after excavation, collection and sale will have to be verified by paying the fee as per the law of Koshi Province.

27. The certification fee will have to be paid to the municipality. In the case of riverine/stream-based products that have not been submitted for stock certification by mid-Ashar and whose stock has not been certified as per the rules, the municipality may seize them and sell them at auction or make a decision as per the need.

28. The deposit amount of the firm/company entering into the contract agreement will not be matched with the contract amount. Similarly, when returning the deposit amount after the contract period ends, an application must be submitted to the Inland Revenue Office along with a copy of the tax payment certificate.

29. The bidder shall be responsible for the preparation of the contract and all associated costs.

30. The excavation and collection of riverine materials shall be subject to the conditions mentioned in the IE report and shall be approved by this office.

The IE report will be an integral part of this bid.

31. The bidder may visit the river crossings to be excavated at his own expense.

32. This office shall have the right to correct any discrepancies in the bidding documents or bidding notice. 33. The bid purchased by one firm or company shall not be used/submitted in the name of another firm or company.

34. The contractor himself shall be responsible for maintaining the tax collection rate in a manner visible to all stakeholders.

35. In the event of any difference of opinion between the bidder and the municipality, the decision of the municipality shall be considered final.

36. The sole right to accept or reject the bid shall remain vested in this municipality.

37. Bidders participating in this process will be deemed to have accepted all the terms and conditions mentioned in the notice and the Standard Bid Document.

38. Further clarification and interpretation of the above-mentioned terms and conditions, as well as other matters not mentioned in the notice, shall be in accordance with prevailing law and established principles of good faith.

39. The matters mentioned in this notice shall be governed by this notice and in respect of other matters, the prevailing laws, regulations and the decision of Sundarharaincha Municipality shall be final.
