As per Section 11 (6) and 64 of the Local Government Operation Act, 2074 BS and the decision of the Thabang Rural Municipality, Village Executive, the contract arrangements under the following titles under the Thabang Rural Municipality area are to be made on the basis of the annual minimum amount determined by this office for the fiscal year 2082/83, and accordingly, confidential sealed bids are invited from individuals, firms or companies who wish to receive bids within 15 days from the date of publication of the notice, subject to the following written conditions, by submitting their firm renewal certificate, value added tax registration certificate, permanent account registration certificate and certified copy of tax payment for the fiscal year 2080/081. ng

Conditions relating to bidding

The bid form can be purchased from the General Administration Branch of this office by paying the prescribed fee within the office hours up to the 15th day from the date of publication of the notice and the bank voucher must be submitted showing that the form fee has been deposited in the account G 1.1 Internal Revenue Account Thabang 28504010000009 (Code No. 14229) of Global IME Bank Nepal Limited Thabang branch of this office. As per the rules, the bids that have been registered will be registered within 12 noon on the sixteenth day and opened in the presence of the bidders at 2.00 pm on the same day at this office. There will be no obstacle to opening the bids even if the bidders are not present. If the day of purchase, registration and opening of bids falls on a public holiday, the aforementioned activities will be carried out on the next day when the office is open.

The bidders shall purchase the bid forms certified by this office by themselves or by sending the document through a duly authorized courier and paying the prescribed fee. 3. While purchasing the bid forms, firms or companies shall submit the business registration certificate and permanent account number/CIT certificate and a certified copy of the tax payment for the fiscal year 2080/081 along with the application.

While submitting the bid form, the bidder should clearly write the amount bid in figures and words and submit a deposit amount of at least 5% (five percent) of the bid amount in the original bank voucher or a bank guarantee of at least 120 days validity in the name of this office from a recognized bank depositing the amount in the C 1.1 Deposit Account 2850401000003 at the Global IME Bank Nepal Thabang Branch along with the sealed bid. In case of difference in the amount bid in figures and words, the amount written in words will be accepted.

5. Bids submitted by contractors who have not settled any contract from this office before will not be accepted. However, if the settlement is made before the bid is submitted, there will be no obstacle to submitting the bid.

6. After the bid is accepted, the bidder will have to submit a performance bond issued by a recognized commercial bank in the name of this office, valid until at least mid-Shravan 2083.

7. The approved contract amount has been divided into two installments. The first installment is 50% (fifty percent) and the last installment is 50% (fifty percent). The first installment is 50% to be paid at the time of signing the agreement, and for the remaining 50%, a bank guarantee (Performance Bond) valid until the end of Shrawan 2083 (mid-August) must be submitted as security from a commercial bank recognized by the Government of Nepal. The remaining 50% installment must be paid within 6 months of signing the agreement.

Heavy equipment larger than loaders, dozers, excavators, JCBs, and 6-wheeled vehicles may not be used for the purpose of extracting natural resources.

9. Excavation and collection of stones, gravel, sand and other natural resources shall not be permitted from sunset to sunrise. 10. If the price of natural resources has been reduced in the technical estimate for public development projects to be operated by the Consumers' Committee in the directly affected areas at the local level, they shall be provided free of charge on the recommendation of this office.

11. For the purpose of collecting natural resource utilization and sales tax, the Village Executive Office may determine depots as per the requirement. In addition, the export tax on riverine products exported from the local level shall be paid to the concerned depot. 12. According to the existing legal provisions of the Government of Nepal, riverine products shall be excavated and

Since there is a provision that collection is not allowed, it must be fully complied with.

13. Excavated riverine material shall not be deposited on the banks of the river or in public places. For that, the bidder shall have to manage his own separate land.

14. No claim for exemption or waiver can be made on the grounds of any strike, natural disaster, etc. If any dispute arises during the excavation, collection and transportation of riverine materials, the bidder will have to manage it himself.

15. If the above-mentioned conditions are violated or the installment is not paid within the stipulated time, the rural municipality will terminate the contract and take legal action to recover the remaining installment from the bank guarantee. In addition, 10% additional compensation will be added to the amount to be recovered and the amount will be recovered as a government due.
